Welcome to LilliBean Designs. These Terms of Service ("Terms") govern your use of www.lillibeandesigns.com and shop.lillibeandesigns.com (together, the "Site"), and your purchase of any products, artworks, downloads, courses, or workshops (together, "Products") from LilliBean Designs, operated by Kirstin McCulloch ("LilliBean Designs," "we," "us," or "our"), based in Cowra, NSW, Australia.

By accessing or using the Site, or by placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase from us.

1. About LilliBean Designs

LilliBean Designs is a small, independent art studio creating original mixed media paintings, limited edition art prints, hand-painted collectables, stationery, digital downloads, and creative courses/workshops. All artworks are handmade and, unless stated otherwise, are one-of-a-kind or produced in limited quantities.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order on the Site. By using the Site, you confirm the information you provide is accurate and that you have the legal authority to make purchases.

3. Products, Descriptions & Availability

  • We do our best to describe and photograph our Products accurately, including size, materials, and colour. As artworks are handmade, slight variations between the photographed item and the item you receive (such as colour, texture, or minor imperfections) are normal and part of the handmade nature of the work, not a fault.
  • Original paintings and limited-edition items are sold subject to availability. Where an item is one-of-a-kind, once sold it cannot be reordered.
  • We reserve the right to limit quantities, discontinue Products, or correct pricing or description errors at any time, including after an order has been placed. If this affects an order you've placed, we will contact you before proceeding.
  • Prices are listed in Australian Dollars (AUD) unless stated otherwise, and are inclusive of GST where applicable. Shipping costs are calculated separately at checkout.

4. Orders & Payment

  • Placing an order is an offer to purchase; we may accept or decline any order at our discretion (for example, in cases of suspected fraud, pricing errors, or stock issues).
  • Payment must be made in full at checkout through the payment methods available on the Site. All payments are processed securely by our third-party payment providers; we do not store your full payment card details.
  • You will receive an order confirmation by email once your order is placed. This confirms we've received your order, not necessarily that it has shipped.

5. Shipping

  • Orders are packed with care in the LilliBean Designs studio in Cowra, NSW, and are typically shipped within 48 hours of receipt of order, via Australia Post unless otherwise noted on the product listing.
  • Free shipping is offered on Australian orders of $99 AUD or more.
  • International shipping is available and calculated at checkout, except where shipping is temporarily paused for a destination (for example, shipping to the United States is currently paused due to tariff-related changes affecting delivery). Any such pauses will be noted on the Site.
  • Unless you select Express Post (which includes tracking and insurance), orders are not tracked or insured, and we are not responsible for items lost or damaged in transit. Full details are set out in our Shipping Policy.

6. Returns, Refunds & Cancellations

Our full returns process is set out in our Shop Policies / Returns page, which forms part of these Terms. In summary:

  • Returns must be requested within 14 days of receiving your order, with the item in its original condition and packaging.
  • Gift cards, downloadable products (including courses and workshops), tattoo tokens, and end-of-collection sale items are non-refundable.
  • Return shipping costs are non-refundable for change-of-mind returns.
  • We only replace items that are defective or damaged on arrival — please contact us at hello@lillibeandesigns.comwith photos as soon as possible after delivery.
  • Nothing in this section limits any consumer guarantee or right you have under the Australian Consumer Law that cannot be excluded (see Section 10 below).

7. Digital Products, Courses & Workshops

  • Digital downloads, printables, courses, and workshop materials are for your personal, non-commercial use only, unless a licence for another use is expressly stated at the time of purchase.
  • You may not resell, redistribute, share, or publish digital Products or course materials, in whole or in part, without our prior written permission.
  • Due to the nature of digital content, all digital purchases are final and non-refundable, except where required by law (for example, if the file is faulty or you were sent the wrong item).

8. Commissions, Wholesale & Consignment

Custom commissions, wholesale, and consignment arrangements may be subject to additional terms agreed directly between you and LilliBean Designs (for example, via email or a separate agreement). Where there is any conflict, those specific terms will take priority over these Terms for that arrangement.

9. Intellectual Property

  • All artwork, images, designs, text, photographs, videos, and other content on the Site are the original creation of Kirstin McCulloch and are protected by copyright and other intellectual property laws. All rights are reserved.
  • Purchasing a physical or digital Product gives you ownership of that item only — it does not transfer copyright, reproduction rights, or any licence to use the artwork commercially, unless expressly agreed in writing.
  • You may not reproduce, scan, copy, republish, or use our artwork or content (including for print-on-demand, resale, or AI training purposes) without our prior written consent.
  • The LilliBean Designs name, logo, and branding may not be used without our permission.

10. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law (or any other law) that cannot lawfully be excluded. Where our Products come with guarantees that cannot be excluded under the Australian Consumer Law, you are entitled to a replacement or refund for a major failure, and compensation for other reasonably foreseeable loss or damage. You are also entitled to have the Products repaired or replaced if the Products fail to be of acceptable quality and the failure does not amount to a major failure.

Where permitted by law, our liability for a failure to comply with a non-excludable consumer guarantee is limited, at our option, to replacing or repairing the Product, supplying an equivalent Product, or paying the cost of doing so.

11. Limitation of Liability

To the maximum extent permitted by law, and subject to Section 10 above:

  • LilliBean Designs is not liable for any indirect, incidental, or consequential loss arising from your use of the Site or purchase of Products, including loss of enjoyment, minor variation in handmade items, or delays in shipping.
  • Our total liability for any claim relating to a Product is limited to the amount you paid for that Product.
  • We are not responsible for delays, loss, or damage caused by third parties, including postal and courier services, once an item has been dispatched (except where covered by Express Post insurance).

12. Reviews & User Content

If you submit a review, comment, testimonial, or other content to the Site, you grant LilliBean Designs a non-exclusive, royalty-free licence to display and use that content in connection with promoting our Products. You agree not to submit content that is false, defamatory, offensive, or infringes anyone else's rights. We may remove any content at our discretion.

13. Website Use

You agree not to misuse the Site, including by:

  • attempting to gain unauthorised access to the Site or its systems;
  • using the Site for any unlawful purpose;
  • scraping, copying, or reproducing Site content without permission; or
  • interfering with the proper working of the Site.

14. Third-Party Links

The Site may contain links to third-party websites or services (such as social media, payment processors, or email platforms). We are not responsible for the content, policies, or practices of any third-party sites.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, Products, or legal requirements. The updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Site after changes are posted means you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute arising from these Terms or your use of the Site.
